Kolkata, September 19 (IANS) West Bengal Police on Friday faced a division bench of the Calcutta High Court, allegedly not launched any disciplinary action against a woman police of Tarkeshwar police station in Hooghly district, accused of demanding a bribe from a citizen.
The division bench of Justice Debangshu Basak and Justice Shabar Rashidi also questioned why the police department has not taken action against the accused police under the prevention of the Corruption Act, 1988. The Division bench also questioned why the police department had not filed any FIR against him.
The Division Bench said that although a show-cause notice was issued by his department on the basis of a complaint to demand a COP to bribe a citizen, the “bribe” case was not mentioned in the relevant document.
While presenting his arguments, the state government’s counsel said that in addition to issuing the show-causal notice, the accused police were also suspended and the department’s investigation was started on 17 September.
In the show-causal notice, the accused police were also asked to clarify why his services should not be abolished on the basis of demand for bribe from a citizen; The Public Prosecutor informed the Division Bench during the hearing in the case on Friday afternoon.
He has also been charged with negligence and insult to duty by his department, informing the court by the state government lawyer. However, the Division Bench dismissed this last point of logic and noticed that what the accused police did was not simple negligence and insult to duty, but a violation of faith as a police personnel for the whole society.
Subsequently, the Division Bench directed the state government to consider the court its final stance in the matter by 22 September. Based on the explanation given by the administration, the division bench will give its next direction in the case.
