Allahabad HC refuses the demolition of the Sambhal Mosque, directing the petitioners to transfer the trial court

In a shock for Prayagraj, October 4 (IANS) petitioners, the Allahabad High Court on Saturday dismissed an immediate petition filed by the Sambhal Mosque Committee, in which a mosque, marriage hall and the demolition of the hospital were allegedly built on government land.

The single-judge bench of Justice Dinesh Pathak listened to the argument left by Masjid Sharif Gausul Vara Rao Rao elder and its Mutavalli, Minjar.

After hearing the debate from both sides, the court disposed of the petition and directed the Masjid Committee to contact the competent lower court with an application.

The petitioners challenged on 2 September passed under Section 67 of Uttar Pradesh Revenue Code, 2006.

He argued that the marriage hall, already collapsed with four bulldozers on 2 October, was built on the land of the pond, but claimed that Gandhi Jayati and Dashehar were at risk of law-and-order disturbances by advancing the demolition on Jayati and Dashehar.

The administration also gave a notice to the mosque, some parts of which have been allegedly built on government land, giving the committee a four -day deadline.

Even before the deadline ended, members of the Masjid Committee allegedly began to pull themselves down the walls of the wall.

On Dussehra Day, the Sambhal district administration launched a major demolition campaign against illegal encroachments, bringing down a marriage hall built on government land in Rao Bujarg village.

The operation carried out on Thursday morning converted the area into a heavy security area, with about 200 police and provincial armed Constable (PAC) personnel deployed. In real time, drones were also used to monitor exercise.

During the final hearing on Friday, the High Court asked the petitioners to present the land records. The State Government, District Magistrate, Superintendent of Police Sambhal, Adam, Tehsildar and Gram Sabha were nominated as parties in the petition.

Advocates Arvind Kumar Tripathi and Shashank Shri Tripathi represented the Masjid Committee, while chief permanent lawyer JN Maurya and permanent lawyer Ashish Mohan Srivastava attended the government during the hearing on Saturday.
