New Delhi, Oct 9 (IANS) Chief Justice of India (CJI) BR Gavai on Wednesday broke his silence on the recent incident in which a lawyer attempted to throw an object at the bench headed by him, saying he and his fellow judges were “very shocked” at the time, but have since considered the matter as “a forgotten chapter”.
CJI Gavai said, “I and my learned brother were very shocked by what happened on Monday. For us this is a forgotten chapter.”
His comments came during a discussion when senior lawyer Gopal Sankaranarayanan recalled a similar incident ten years ago. “Something similar happened in a neighboring court 10 years ago. Two judges there had different views on what procedure should be followed while using contempt powers,” Sankaranarayanan said.
Solicitor General Tushar Mehta, the Centre’s second-highest law officer, said the lawyer’s actions were “completely inexcusable”, adding that he was spared only because of CJI Gavai’s “generosity”.
On Monday, CJI Gavai decided that no action would be taken against lawyer Rakesh Kishore, who came on the dais and allegedly tried to take off his shoe, but security personnel immediately intervened and escorted him out of the courtroom.
While being taken away, he was heard raising slogans referring to Sanatan Dharma.
The proceedings were interrupted for a while, but CJI Gavai remained calm and continued without interruption. He had said, “Don’t get distracted by all this. We are not distracted. These things do not affect me.”
Meanwhile, Karnataka Police on Wednesday registered an FIR against the 71-year-old teenager following a complaint by All India Advocates Association president Bhaktavachala.
The Vidhana Soudha police in Bengaluru have registered a zero FIR against the juvenile under sections 132 and 133 of the Indian Justice Code (BNS) on charges of assault or battery to prevent a public servant from discharging his duties and using criminal force with intent to insult any person. Zero FIR is an FIR that can be lodged at any police station, irrespective of where the crime took place or the jurisdiction of the police station. Police sources said the case will be transferred to the jurisdictional police in New Delhi.
