The health care giant immediately announced its intention to appeal the liability verdict and compensatory damages.

The ruling represents the latest development in a lengthy legal battle over allegations that talc in Johnson’s Baby Powder and Shower to Shower Body Powder is linked to ovarian cancer and mesothelioma, a cancer that affects the lungs and other organs. Johnson & Johnson will stop selling powder made from talcum powder worldwide in 2023.

In the latest case, the jury awarded Monica Kent $18 million and Deborah Schultz and her husband $22 million. “The only thing he did was be loyal to Johnson & Johnson as a customer for 50 years,” said his lawyer, Daniel Robinson of the Robinson Calcagni law firm in Newport Beach, Calif. “That loyalty was one-sided.”

Eric Haas, J&J’s worldwide vice president of litigation, said in a statement that the company had “won 16 of the 17 ovarian cancer cases previously tried” and expects to do so again if it appeals Friday’s decision.

Haas called the jury’s findings “inconsistent with decades of independent scientific evaluations that confirm that talc is safe, does not contain asbestos, and does not cause cancer.”

Johnson & Johnson replaced talc with cornstarch in its baby powder sold in most of North America in 2020 after declining sales.

In April, a US bankruptcy court judge rejected J&J’s plan to pay $9 billion to settle claims of ovarian cancer and other gynecological cancer litigation based on talc-related products.
