The Supreme Court on Friday (October 31) barred investigating officers from issuing summons to lawyers advising the accused.
The apex court had taken suo motu cognizance of the ED’s summons issued to lawyers issuing opinions and advice to people facing investigation.
The apex court has cautioned the investigating officers from violating fundamental rights and statutory norms.
The court said that summons can be issued only in exceptional cases. It says that even in exceptional cases, the summons must be authorized by an officer of the rank of Superintendent of Police.
The court ruled that any such summons must clearly state the facts relied upon for issuing it.
