Election Commission counsel Niranjan Rajagopal made this submission before the first bench of Chief Justice MM Srivastava and Justice G Arul Murugan when a PIL filed by C Selvakumar, seeking de-recognition of Tamilaga Vetri Kazhagam (TVK), among other reliefs, came up for hearing.
The demand for de-recognition of TVK was made in the wake of the stampede at the party’s rally held in Karur on September 27, in which 41 people were killed. Vijay participated in the rally.
The bench directed the Registry to place all the cases related to the September 27 Karur stampede before the administrative side of the High Court so that a bench can be constituted to deal with those cases, except those cases which were pending before the Supreme Court.
As far as the prayer for derecognition of TVK is concerned, Niranjan Rajagopal said that the party is not recognized and hence the prayer will not stand.
Originally, this petition was filed in the Madurai bench of Madras HC, but it was transferred and listed before the first bench as the first respondent in the petition was the Chief Election Commissioner (CEC).
As far as the prayer for change in the FIR against Vijay is concerned, the bench said it will be effectively dealt with by the Supreme Court order directing a CBI investigation in the case.
In his plea, Selvakumar sought a direction to the ECI to strictly enforce the ban on the use of children and women in any political rallies, processions and election campaigns across the state, in strict compliance with the direction dated February 5, 2024. derecognition
They also sought to direct the TVK leadership to be held accountable for allegedly illegally organizing women and minor children, resulting in mass deaths.
They also sought direction to TVK to pay adequate compensation – a minimum of ₹ 1 crore per deceased and proportionate relief to the injured persons.
