Victorian Director of government prosecutionWho has a car Erin Patterson Case of murder, She chose to appeal against what she considers a highly liberal sentence,
It comes behind the news last week that the convicts have instructed their lawyers to appeal against his punishment.
These appeals can expand the life of the high-profile case, or it can exit all quickly. What is happening here now and what comes next.
From lunch to life sentence
In September, Patterson Three murder cases and a count of murder attempt were sentenced To serve poisonous beef wellington mushroom For guests at his home in regional Victoria in July 2023. It conducted a long, infamous test.
Victorian Supreme Court Justice Christopher Belle ordered a lifetime sentence with a 33-year non-panel period. Given her age (50) and at the time she used to spend in custody, Patterson would not be eligible to apply for parole until 2056, when she is in the 80s.

The law usually gives both prosecution and defense to file any appeal after 28 days after 28 days.
The period would have ended on Tuesday, October 7, but both legal teams have demanded further expansion of 28 days under a new process at the end of last month. This allows for a total of 56 days (28 days and 28 days) if the initial information of the appeal is filed within the first 28 days.
This is what both teams are doing now, but for very different reasons.
Patterson’s appeal
Erin Patterson The barrister has a new team, not only high-profile lawyer Julian McMahon, but also the famous criminal law academic and author Richard Edney.
Under the Victorian Criminal Procedure Act, any person should be found to be guilty or to appeal to the first appeal to appeal for punishment. This means permission to appeal basically.
The holiday is heard by a single judge of the Supreme Court. This judge will determine whether the appeal grounds (reasons) have sufficient qualifications, which is a warrant for warrant for complete hearing of the court.

Judge may give Patterson such a holiday to appeal against his sentence on any or all three grounds.
The first is the place where the jury’s decision is considered inappropriate and is not supported by evidence.
This ground was successfully sought George Pale Appeal decision, where High court It was determined that his convicts were unworthy. High court It was decided that it was not open to the jury to find Pale guilty beyond proper doubt.
Another basis is that the trial judge insufficiently paid attention to the jury’s attention. This is not very likely to be raised in the Paarson appeal.

A third ground is the place where there is adequate abortion of justice during testing. This argument is usually based on a defense submission that some are allowed in evidence (by trial judge), which should not have been introduced, or that some were not allowed in evidence (excluded by the trial judge) which should be admitted to evidence.
One can strongly guess that this is where the appeal for defense will go ahead.
Prosecution appeal
Either the party can appeal for punishment. Thus, the prosecution should also get a holiday to appeal to a judge to pursue their case.
In this case, the prosecution is now trying to do so, and it will need to be submitted that the punishment is clearly – only not – highly generous.
As Patterson was sentenced to three lives (should be served concurrently), the prosecution would argue that the 33-year non-paroll period (not uncommon in cases of single housewives) was clearly inadequate.
It is highly impossible that defense will overcome the severity of punishment, given that the triple murderer may be expected to achieve.
What happens if the appeal is allowed?
If the defense appeal against the punishment is allowed, the court can either acquit Patterson or send the entire case back.
In the case of a successful appeal against the punishment by the prosecution, the appeal court can either apply a long non-parole period, or send back the trial judge to send the case again.
There will be a lot to inspect in the next phase of the criminal justice process. The first hurdle for Patterson is to get a holiday to appeal. In that hearing, we will know for the first time where the arguments of the appeal are, and in fact, what will appear further.
