Delhi HC asked Yasin Malik to respond to Nia’s plea for death sentence

New Delhi, August 11: Delhi High Court on Monday demanded a reaction of separatist leader Yasin Malik on a petition filed by the National Investigation Agency, demanding a death sentence for him in a terrorist funding case.

A bench by Justices Vivek Chaudhary and Shalinder Kaur gave Malik four weeks to register his response to the NIA plea.

The court posted the hearing for 10 November.

Malik, who had previously demanded to be argued against the NIA’s petition, demanded an increase in in-purses, should have revealed virtually from jail, but was not produced.

The Jammu and Kashmir Liberation Front Chief (JKLF) has been recorded in Tihar Jail, where he is serving a life period in the case.

The High Court mentioned that neither Malik was virtually produced in the proceedings from jail nor did he file his reply on Nia’s plea in the court’s order of August 9, 2024.

On 9 August, Malik was directed not to be born almost and physically due to safety threats.

On Monday, the bench directed the jail authorities to produce it almost on 10 November.

Malik last year rejected the court’s suggestion to appoint a lawyer on his behalf and said he wanted to argue with the person in the case.

On May 29, 2023, the High Court issued a notice to Malik on the NIA petition demanding a death sentence.

Subsequently, the jail authorities filed an application, demanding permission for his virtual presence that he was a “very high -risk prisoner” and it was mandatory to physically produce him in court to maintain public orders and security.

The request was allowed by the High Court.

On May 24, 2022, a trial court sentenced Malik to life imprisonment after being convicted of strict illegal activities (prevention) Act (UAPA) and IPC for crimes.

Malik convicted the allegations including those under the UAPA, and was convicted and sentenced to life imprisonment.

Appealing against the punishment, the NIA emphasized that a terrorist could not be punished for a life period because he has convicted and selected not to go through the test.

Demanding to increase the sentence of death sentence, the NIA said that if such a dreaded terrorists are not punished for conviction, there will be complete erosion of the policy of punishment and the terrorists would have a way to avoid capital punishment.

The trial court, which dismissed the NIA’s plea for the death sentence, said that the crimes committed by Malik hit the “heart of India’s idea” and its purpose was to force Jammu and Kashmir from the Union of India. (Agencies)
