CBI Books J&K Police DSP, 5 other officers on fellow constable for ‘cruel custodial torture’

New Delhi, July 28: CBI has booked six officers of Jammu and Kashmir Police after allegations of “cruel and inhuman custodial torture” on a fellow police constable two years ago.

In its FIR registered on the orders of the Supreme Court, the Central Agency has nominated Deputy Police Superintendent Aiz Ahmed Naiko and five others, who were then posted at the Joint Inquiry Center, Kupwara, said.

Apart from DSP Naiko, Sub-Inspector Riyaz Ahmed and four other J&A police officers- Jahangir Ahmed, Imtiaz Ahmed, Mohammad Yunis and Shakir Ahmed- have been named as allegedly “cruel and inhuman patrons to torture” in six days.

The victim, who was posted in Baramullah, was called through a signal communication on February 17, 2023, to report before the SSP, Kupwara Operately to investigate an intoxicating case for investigation in a drug case.

In its FIR, the agency has not nominated the SSP as an accused.

Khurshid contacted the Supreme Court with a cool petition after the Jammu and Kashmir High Court dismissed the petition seeking a CBI inquiry.

Handing over the case to the CBI, the apex court stated that the High Court “failed to exercise its constitutional obligation to protect the fundamental rights of a citizen, his dignity and life rights”.

A bench of Justices Vikram Nath and Sandeep Mehta said, “It failed to consider the gravity of crimes and at the same time the impact of the accused being a police officer can be affected.”

The apex court also ordered Khurshid to pay Rs 50 lakh in compensation, which will be recovered from the concerned officer (S), against which a departmental proceedings will be initiated by the CBI at the conclusion of the investigation.
