Kupwara, July 20: In a letter, which raises rapid constitutional and political concerns, Kupwara MLA Mir Mohammad Fayz has accused a advisor of the Chief Minister of the Chief Minister of “high-constitutional intervention” in matters of his constituency.
In a communication addressed to the Chief Secretary of Jammu and Kashmir, the MLA alleged that the advisor – a former political rival who had recently lost the assembly elections – “In Kupwara,” to reduce the right of an elected representative “without any constitutional mandate in administrative and governance matters”.
“The MLA’s organization is a consultant pillar of democratic rule, which is directly empowered by the People’s mandate,” Fayz wrote in his letter. “In question, the advisor has no constitutional status to bypass or override the election decision of the people of Kupwara.”
Faiz further said that the advisor is calling government officials, participating in meetings for elected MPs, and affects the decisions related to Kupwara constituency.
He called the consultant’s actions “major attacks on democracy” and accused the ruling party of trying to reverse the democratic results of recent elections by “bureaucracy using bureaucrats”.
The letter stated, “He is a regular invite for official meetings related to Kupwara, where his input is entertained, while I am disobedient.”
Questioning widespread constitutional implications, Fayz asked if a ruling party is legally acceptable to expand legislative privileges to a non-elevated person to reduce the rights of the MLA duly elected by the opposition.
He wrote, “I formally define his presence in official meetings and his intervention in the constituency until his constitutional role is clearly defined,” he wrote. (KDC)
