Trump’s “(RINO!) DA” remarks appeared to be a reference to Dan Rubinstein, the Republican district attorney for Colorado’s 21st Judicial District, who prosecuted Peters’ case. His “despicable” comment was an apparent reference to Colorado Democratic Gov. Jared Polis.

The president made fiery remarks after issuing a presidential pardon to Peters on Dec. 5, although his pardon power does not apply to state crimes.

Last week, however, the former clerk’s attorneys asked a judge to grant the pardon, saying the Colorado Court of Appeals no longer had jurisdiction over her case. They also asked the court to release her on pardon.

The appeals court later ruled that attorneys from the state attorney general’s office defending the conviction have until Jan. 8 to respond to Peters’ arguments.

Peters claims the state judge who sentenced her to nine years in prison violated her First Amendment rights by punishing her for alleging election fraud.

In his October 2024 sentencing, Judge Matthew Barrett called Peters a “charlatan” and said she posed a danger to the community by spreading lies about voting and undermining the democratic process.

Peters is unapologetic and insists everything she does is to root out what she sees as fraud. She claimed her actions were for the greater good.

Peters was convicted of allowing a man to misuse a security card to gain access to the election system and defraud the man’s identity. The man has ties to MyPillow CEO Mike Lindell, a well-known promoter of false claims that voting machines were rigged to steal the election from Trump.
