Additional District Judge Saurabh Dwivedi rejected the public prosecutor’s appeal under Section 321 of CrPC to drop charges against the 14 surviving accused, Live Law reports.
The state government filed a petition in the local court in October this year to withdraw the case against the accused. The Assistant District Government Counsel (ADGC), Crime, submitted an application in the trial court under Section 321 of the CrPC for withdrawal of the prosecution.
Akhlaq’s lawyer Yousuf Saifi said on Tuesday that the court delivered a strong verdict in favor of the Akhlaq family in the ongoing case.
He told ANI, “The case of mob lynching, which was going on in the court with evidence… The government filed an application through the government lawyer to withdraw the case from the court… Rejecting all their arguments, the judge set an example and justice was given to the Akhlaq family… The excellent order which should have been issued in a case like mob lynching has finally been issued.”
Meanwhile, Mohammed Akhlaq’s wife also moved the Allahabad High Court against the government’s decision to withdraw the case as well as the withdrawal application filed by the prosecutor.

Fifty-year-old Akhlaq was thrashed to death by a mob in Dadri area of Gautam Buddha Nagar on September 28, 2015, over allegations that he had eaten beef during Eid and stored it to eat later.
Police initially registered an FIR under several sections of the IPC, including murder charges. On 29 September 2015, a case was registered against 10 people under IPC sections 147 (punishment for rioting), 148 (rioting armed with deadly weapon), 149 (unlawful assembly), 302 (murder), 307 (attempt to murder), 458 (house-trespass or house-breaking), 504 (intentional insult with intent to provoke breach of peace). FIR was registered.
In October 2015, 8 people mentioned in the FIR were arrested in the case.
A total of 18 people were arrested in connection with the lynching, including three minors.
In December 2015, the police had filed a charge sheet against 15 people, including a minor. But there was no mention of beef in the charge sheet.
On June 9, 2016, Surajpal, a resident of Bisara village, had filed a petition to register an FIR against Akhlaq and his family for eating beef.
The same month, Judicial Magistrate Vijay Kuar of Surajpur District Court issued an order to register an FIR against Akhlaq and his family under section 156 (3) of the CrPC.
In August 2016, the Allahabad HC granted immunity from arrest to all members of Mohammad Akhlaq’s family except his brother Jaan Mohammad until the investigation in the case is completed.
One of the accused died in October 2016 after suffering from breathing problems and high fever.
Two other accused in the case – Puneet and Arun – got bail on April 29, 2017.
On July 31, 2017, Vishal Rana was the 14th person to get bail in this case.
In September 2017, the last of the 18 accused in the Dadri lynching case – Rupendra – was granted bail.
In October 2025, the state government filed a petition in the local court to withdraw the case against all the accused.
On 23 December, a fast-track court in Gautam Buddha Nagar rejected the government’s application to withdraw the prosecution case.
The next hearing in the case is to be held on January 6, 2026.
