A division bench of Justices Vijay Kumar Shukla and Binod Kumar Dwivedi asked the civic body to submit an action taken report with details of sterilization of stray dogs by January 13. The court warned that if the report is not satisfactory then it can order the Municipal Commissioner to appear in person.
These directions were issued during a public interest litigation (PIL) seeking removal of livestock like cattle, sheep and goats from public areas within the city limits to protect greenery. The issue of stray dogs was also raised in the petition.
According to Bar and Bench, earlier, the Court had asked the State to update itself on the measures taken by the IMC to deal with stray dogs, in line with the directions issued by the Supreme Court in November. On December 19, the state informed the court that the civic body has taken certain steps with regard to both stray cattle and stray dogs and is actively working to remove stray cattle from the city.
However, counsel for the interveners said that the problem of stray dogs persists across Indore, with several incidents of dog bites reported. Taking note of this, the Court directed the IMC to strictly follow its earlier orders and the directions of the Supreme Court.
To ensure proper implementation, the division bench also directed the Municipal Commissioner to hold a meeting with the officials concerned and prepare a detailed action plan within 10 days.
Advocate Gagan Bajad appeared on behalf of the petitioner, while senior advocate Piyush Mathur and advocate Madhusudan Dwivedi appeared as amicus curiae. Government counsel Bhuvan Gautam represented the state, and advocates Kirti Patwardhan and Manish Yadav represented the respondent/intervenor.
