Srinagar, June 24: The High Court of Jammu and Kashmir and Ladakh recently directed the Union Home Ministry to re -prepare a 63 -year -old woman, which was sent to Pakistan after the Pahgam Terrorist attack.
The High Court passed the order, focusing on the “extraordinary nature of facts and circumstances” of the case, as the petitioner had been living in India for almost four decades and holding a long -term visa (LTV).
The High Court directed to comply with the order of the order (6 June) within ten days and posted the case on 1 July for the compliance report.
Justice Rahul Bharti passed direction in a petition filed by a woman named Raksand Rashid, through her daughter Falak Zahoor.
The petitioner’s husband Sheikh Zahoor Ahmed told the court that there was no one in Pakistan for care and custody and was suffering from many diseases.
Given that human rights are sacred, the court passed an extraordinary direction.
“Human rights is the most sacred component of human life and therefore, there are occasions when a constitutional court is going to come up with an SOS such as the merit and demerits of a case despite the merit and demerits, which can only be postponed during the time and, therefore, this court is coming with a direction for the ministry of the house.”
The court also stated that since it had a long -term visa, his exile could be unfair and was forced without proper order of exile.
“This court is taking this background in mind that the petitioner was getting the status of LTV at the relevant time, which a person could not warrant his exile, but in a better perspective, he was coming with a proper order regarding his exile without investigating his case and without investigating his case, yet he was forced.” (Livelaw)
